Responding to your request for information or a viewing

When you complete a form, call us or request a viewing, we process your first name, surname, telephone number, email address, the reference of the property you are interested in and whatever you tell us in your message.

• Purpose: to reply to you, send you details of properties that match your search and arrange viewings or video calls.
• Legal basis: the taking of pre-contractual steps at your request (Art. 6(1)(b) GDPR) and your consent when you tick the relevant box (Art. 6(1)(a) GDPR).
• What happens if you do not provide it: we will be unable to deal with your request. The fields marked with an asterisk are essential.

Sending you properties we do not advertise

If you request access to our off-market portfolio, we use your data and your search criteria — area, budget, type of home — to send you properties that are not advertised publicly.

• Legal basis: your consent (Art. 6(1)(a) GDPR), which you may withdraw at any time without affecting the lawfulness of processing carried out beforehand.

Recording of telephone calls

If you call the number shown on this website, a message informs you, before you are connected to us, that the call may be recorded; if you continue, we record it. We use the recording and its transcript to handle and follow up on your request, improve the quality of our service and keep a record of what was discussed. The transcript is produced by a text-processing provider acting on our behalf.

• Legal basis: your consent, which you give by continuing the call after the notice (Art. 6(1)(a) GDPR), and our legitimate interest in managing the business relationship and evidencing what was agreed (Art. 6(1)(f) GDPR).

Measuring and improving the website

If you authorise it in the cookie notice, we carry out statistical analysis of how the site is browsed and which adverts bring visits, in order to improve the pages and refine our advertising.

• Legal basis: your consent (Art. 6(1)(a) GDPR and Art. 22(2) LSSI-CE). You may withdraw it whenever you wish from cookie settings.

Complying with legal obligations

Retention of commercial and tax documentation and, where applicable, that required by anti-money-laundering legislation.

• Legal basis: legal obligation (Art. 6(1)(c) GDPR).

3. How long we keep it

• Enquiries that do not proceed: up to 12 months from the last contact, unless you ask us to erase it sooner.
• Clients: for as long as the relationship lasts and, thereafter, for the applicable statutory limitation periods (generally 6 years in commercial matters).
• Cookie consents: 24 months at most, after which you are asked again.

4. Who we share your data with

We do not sell your data or pass it on for third parties' advertising purposes. It is accessed only by those who provide us with services needed to assist you, always under a data-processing agreement in accordance with Art. 28 GDPR:

• Web hosting provider.
• Sales-management and viewing-scheduling tool (CRM).
• Digital measurement and advertising providers, only if you have given your consent in the cookie notice.
• Other companies in the Huspy group and our partner agencies on the Costa del Sol, exclusively where necessary to locate a property that matches your search and always with your knowledge.
• Public authorities and notaries, where there is a legal obligation.

Some of these providers may process data outside the European Economic Area. In that case, the transfer is covered by adequacy decisions of the European Commission or by standard contractual clauses, with any additional safeguards that may apply.

5. Your rights

You may exercise at any time your rights of access, rectification, erasure, objection, restriction of processing and portability, as well as withdraw any consent you have given.

If you feel we have not handled your request properly, you may lodge a complaint with the Spanish Data Protection Agency (C/ Jorge Juan 6, 28001 Madrid — www.aepd.es).

6. Security

This site uses TLS encryption on all communications, and we apply appropriate technical and organisational measures to protect your data against loss, misuse or unauthorised access. Even so, no transmission over the internet is entirely invulnerable.

7. Automated decisions and minors

We do not make automated decisions with legal effects, nor do we build profiles that significantly affect you. This site is not directed at children under 14 and we do not knowingly collect their data.
